1. Agreement to Terms

By accessing or using Microstep ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

3. Description of Service

Microstep is a personal tracking application that helps users track habits, goals, and metrics with customizable fields. The App is provided on an "as is" and "as available" basis.

4. User Accounts

4.1 Account Creation

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Security

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Subscription and Billing

5.1 Free Tier

The free tier includes limited features (2 projects and 30 log entries). Free tier limitations may change at our discretion.

5.2 Paid Subscriptions

Paid subscriptions provide access to unlimited projects and entries. By subscribing, you agree to pay the applicable fees.

5.3 Auto-Renewal

Paid subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your App Store account settings.

5.4 Refunds

Refunds are handled by Apple according to their App Store policies. We do not directly process refunds.

5.5 Price Changes

We reserve the right to change subscription prices. Price changes will not affect your current subscription period but will apply upon renewal. We will provide reasonable notice of price changes.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality
• Upload malicious code, viruses, or harmful content
• Reverse engineer, decompile, or disassemble the App
• Use the App to collect data about other users
• Impersonate any person or entity
• Use automated systems or bots to access the App

7. Fair Usage Policy (AI-Powered Features)

Certain features of Microstep are powered by artificial intelligence and large language models (LLMs). These features are subject to fair usage limits to ensure service quality for all users.

7.1 Usage Limits

• Rate Limits: AI-powered features may be subject to daily, hourly, or per-request limits based on your subscription tier
• Token Limits: Individual requests may have maximum input/output length restrictions
• Quota Resets: Usage quotas reset on a rolling basis as specified in your account

7.2 Prohibited Uses of AI Features

In addition to the general acceptable use restrictions, you may not use AI-powered features to:

• Generate content that is illegal, harmful, harassing, or violates third-party rights
• Attempt to extract, replicate, or reverse-engineer the underlying AI models
• Resell, redistribute, or provide API access to AI features to third parties
• Circumvent usage limits through multiple accounts or automated means
• Generate spam, misleading content, or content for fraudulent purposes

7.3 Service Adjustments

We reserve the right to:

• Modify usage limits at any time with reasonable notice
• Throttle or temporarily suspend AI features during high-demand periods
• Update AI models, which may affect output quality or behavior

8. Intellectual Property

8.1 Our Rights

The App, including its design, features, code, and content, is owned by Microstep and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 Your Content

You retain ownership of any data or content you create within the App. By using the App, you grant us a limited, non-exclusive license to store, process, and display your content solely to provide the service to you.

8.3 Feedback

If you provide feedback or suggestions about the App, you grant us the right to use that feedback without compensation or attribution.

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand our data practices.

10. Disclaimers

10.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Health or Medical Advice

Microstep is not a medical, health, or therapeutic application. The App is intended for general personal tracking purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions regarding medical conditions.

10.3 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of any data stored in or generated by the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICROSTEP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

• Your use or inability to use the App
• Any unauthorized access to your data
• Any bugs, viruses, or errors in the App
• Any content or conduct of third parties

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Microstep and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the App

13. Dispute Resolution

13.1 Informal Resolution

Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at hello@microstepapp.com. We will attempt to resolve the dispute within 30 days.

13.2 Binding Arbitration

If we cannot resolve the dispute informally, you and Microstep agree to resolve any disputes through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

13.3 Class Action Waiver

YOU AND MICROSTEP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.4 Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement.

13.5 Opt-Out

You may opt out of arbitration by sending written notice to hello@microstepapp.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts specified below.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Delaware.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the App.

16. Termination

16.1 By You

You may stop using the App and delete your account at any time through the App settings.

16.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violations of these Terms, fraudulent activity, or extended periods of inactivity.

16.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. We may delete your data in accordance with our Privacy Policy.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Microstep regarding the App.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
